Millgreen Farm, Chester Road, Aldridge I refer to your letter dated 13th January 200 regarding the use of a building as an office at the above premises. I have no record of any planning application relating to the erection of the building either as an agricultural building or a commercial office and I am unable to confirm when the building was erected. However, inrelation to Millgreen Farm in general, my enforcement Officer Mrs Hibbs has been investigating possible breaches of planning control. As a result of the investigations a retrospective planning application for the change of use of buildings to B1, B2 and B3 industrial use was submitted and consequently refused by the Aldridge South Area Planning Committee. They also authorised the issuing of enforcement notices in relation to unauthorised uses. I am of the opinion that the building, and the area adjacent to it is in breach of the planning regulations. In the Circumstances
The above letter contents indicates that the former regional office at Millgreen Farm, Chester Road, Aldridge, West Midlands, was an improper commercial occupation. FSB Company Secretary/National Secretary/director David Dexter stated in a memo (copy held), that the lease of the office was approved by the 'Federation solicitor' That statement raises serious questions as to the competence of the legal advice procured on behalf of the FSB by Company Secretary David Dexter. The solicitor's firm was ultimately found to be Wallace Robinson & Morgan, based in Solihull, West Midlands. The fact that when contacted the Wallace Robinson & Morgan did not reply to clear their name nor to admit involvement raises further ethics and conduct which the English Law Society should have a duty to police. David Dexter refused to show to concerned FSB members, copies of the relevant correspondences between his office and Wallace Robinson & Morgan. |
Credibility of Evidence By 'Key' FSB Officers Questioned
David Dexter -
Concerns as to credility of evidence given by Mr Dexter was also stated to be questionable by an Employment Tribunal (Scotland) decision given in May 2000. The Tribunal's decision affirmed what a number of FSB members have found and suffered by for some years. As FSB National Secretary, David Dexter is intertwined in questions of appeals from the decision of the FSB's internal dispute and disciplinary processes. His judgement and performance in respect of those duties have exhibited corrupt practices on a number of occasions.
Leroy Bryan -
Also disturbing is the fact that the Tribunal credility of evidence given by Mr Leroy Bryan, Chairman of the FSB's internal Dispute and Disciplinary Committee, was also considered to be questionable. The Tribunal's decision confirmed FSB members suspection that the FSB D&D process could not be relied upon.
Solicitor Timothy Walker -
A final telling blow to the credibility of the FSB D&D process was that the Tribunal also questioned the credibility of evidence given to it by the paid Secretary of the FSB Disputes and Disciplinary Committee, Licoln solicitor, Timothy H M Walker. Is there nothing that Timothy Walker's Law Society can do to clear his name or to protect FSB members from disputes procedures which lack judicial credibility? |
Inquiry Needed
The refusal of the FSB Company Secretary to reveal full and true facts of the matter to clarify contradictions in his statements, supports the call for an independent inquiry into these and other similarly questionable activities in FSB affairs. Such an investiagtion could not be fairly conducted, if done within the FSB or if it is controlled by FSB directors. The instrument of their instructions, FSB Company Secretary David Dexter, has been tainted by his past conduct and is subject of serious allegations which also question his suitability for the 'job'. |
